Innovative Scuba Concepts, Inc. (ISC) wants your ideas. The Next Idea Contest (NIC) was designed to enable divers and non-divers to bring a new product or service idea to the market. We simply request that your idea promises to improve or enhance diving activities through increased utility, enjoyment, comfort, or safety. This is your opportunity to help the sport of scuba diving and possibly win a Grand Prize with value over $7,000.00 including a dive trip, products and industry recognition.

To enter the contest online, simply fill-out the Official Entry Form, electronically sign it and an email will be sent to ISC.

To enter the contest via mail, simply print and fill-out this Official Entry Form, sign it, and mail it to the following address:

Entries should describe an original idea for a product or service that can be used in conjunction with snorkel or scuba diving activities. “Product or Service Ideas” may include (but are not limited to) increased utility, enjoyment, comfort, or safety. After the close of the contest the official judges will evaluate all entries.

Winners of the NIC will be determined by January 2, 2015 and will be notified by ISC. For a list of the winners send a self-addressed, stamped envelope to the above listed address, or send us an email at NIC@innovativescuba.com. The contest is open to legal residents of the United States, Canada, Caribbean and US territories who are 18 years of age or older. All Federal, State, and local laws and regulations apply. Void where prohibited by law.

The contest begins November 18, 2013 and ends December 31, 2014. All entries must be received by the beginning of business on January 2, 2014 Mountain Standard Time to be eligible for the contest. By signing below you expressly release ISC from any and all liability arising from but not limited to transactions, implied responsibilities, entries lost or not received by the contest end date, and/or other claims.

CONTEST RULES AND AGREEMENTS

The following Rules and Agreements govern the contest and all submissions. Void where prohibited by law. By entering the contest and submitting a “Product or Service Idea” the “Entrant” verifies and agrees to the following:

1. The originator/s, innovator/s or inventor/s submitting the new “Product or Service Idea” will be collectively referred to herein these Rules and Agreements, whether one or more, as the “Entrant”. The person whose name appears on an Official Entry Form as the Entrant shall be the person entitled to compete in the contest for prizes. If the material submitted for the contest is the idea of more than one person, the person/s other than the Entrant must sign the Official Entry Form and will be bound by these Rules and Agreements. Only one prize may be awarded for a single submission and shall be awarded to the named Entrant. A new product or service idea may consist of a written description, drawing, photograph, model, video, diagram, or the like and the “Entry” (idea, invention, design, drawings, description and anything submitted to convey the new product idea) shall be collectively referred to in these Rules and Agreements as the “Product or Service Idea”.
2. The Product or Service Idea being submitted is an original idea generated by the Entrant and the Entrant verifies that it has not been copied from another source. Potential winners will be notified by ISC and will be required to sign and return an affidavit certifying that their entry is their own original idea and that they have followed the official Rules and Agreements of this contest. All entry materials submitted in support of the Product or Service Idea will become property of ISC and will not be returned. The Product or Service Idea, underlying concept, invention and patent rights shall become the exclusive property of ISC.
3. Entrant, by mailing, sending electronically, or delivering materials describing, illustrating, detailing, outlining, or laying out the Product or Service Idea to ISC, does hereby assign, transfer and convey to ISC all of the Entrant’s rights, title, and interest in and to the Product or Service Idea, including any future modifications, improvements, enlargements, or redesign thereof which may be made or caused to be made by ISC or its affiliates, officers, agents, employees.
4. Entrant agrees that regardless of whether a prize is awarded for the Product or Service Idea being submitted, ISC may utilize it by making, using, marketing and selling the Product or Service Idea in the form in which it is submitted, or in a form following further development or modification of the original submission, all without compensation or recognition to the Entrant.

IMPORTANT PROPRIETARY RULES AND AGREEMENTS

In the event that ISC, in its sole discretion, decides that a submitted Product or Service Idea should be made the subject of one or more patent applications, domestic or foreign, the Entrant promises and agrees to cooperate in preparing and signing appropriate patent applications, and required papers and documents related thereto, all at the expense of ISC, and agrees to execute a formal assignment of the invention to be recorded in the appropriate patent offices.

In the event a patent should issue from a Grand prize, Second prize and or Third prize winning Entry, then and in that event, ISC may enter into an agreement with the Entrant to pay a royalty of 1% (one percent) of the net sales (less discounts, returns, refunds, and taxes which are collected as part of the sales price) of products covered by the issued patent, which sales are made in the country or territory covered by the patent, for a period of up to 5 (five) years from the initial date the product or service is offered for sale.

Winners of the contest release ISC, and its affiliates, officers, agents and employees from any and all responsibilities or liabilities in connection with the use of any prize. Employees of ISC and their families are not eligible to win. Odds of winning determined by the total number of entries received. Void where prohibited by law. Winners assume responsibility for all federal, state, and local income taxes, sales, and transfer taxes. Dive trip, hotel accommodations, and airfare portions of the prize must be used between January 2, 2015 and June 30, 2015. Entry in the contest constitutes permission to use names and or likeness of Entrants in any manner by ISC without further compensation to the Entrant. All decisions of the official judges are final. There is no purchase necessary to enter or win the contest

GRAND PRIZES AND OTHER WINNINGS

The first place Grand prize has an approximate retail value of $7,000. The Second place prize is valued at $2,600 and the Third place prize is valued at $1,600. All prizes are non-transferable, and no substitution of prizes is permitted. All tax liability for prizes are the sole responsibility of the winners.

ISC reserves the right to reduce or limit the prizes in the program if participation does not meet minimum levels
